The Islamabad High Court has granted bail to Shahid Hussain Khawaja, a co-accused in a massive Rs 3 billion sales tax fraud case, on a bond of just Rs 100. The court condemn the tax department’s actions against Khawaja as a mishandling and sabotage his fundamental rights.

The court’s verdict highlighted that the tax department failed to determine the tax due to the taxpayer according to the law and initiated criminal proceedings in spite of knowing the Lahore High Court’s decision. Justice Babar Sattar, indicate sorrow with the magistrate and trial court for not appertain the law correctly.

The court ordered the Chairman of the Federal Board of Revenue (FBR) to dispense copies of the judgments to tax officers, foregrounding the importance of utilizing legal and police powers in conferring with the law. The FBR and tax officers will face action if found guilty of violating the law.

In Intense Condemnation, the court said it was disgraceful that the magistrate and the court rejected bail despite considering the Sales Tax Act provisions. The court hopes the trial court will examine the legality of the proceedings.
