The Islamabad High Court (IHC) on Monday ordered the Attorney General’s office to submit the complete record pertaining to the arrest and ongoing detention of retired Air Marshal Javed Saeed. Justice Khadim Hussain Soomro issued the directive while hearing a writ petition challenging the legality of Saeed’s detention.
During the hearing, Advocate Inam-ur-Rahim, representing the petitioner, argued that despite acknowledging Saeed’s conviction, his continued detention remains unlawful. He further stated that the defense has not been granted access to any official trial records, which undermines their ability to legally contest the matter.
Justice Soomro reminded the Attorney General’s office that the court had previously requested the record. The absence of documentation prompted the court to issue another notice, instructing that all relevant records be submitted by the next hearing, scheduled for Tuesday next week.
The case originates from a petition filed under Article 199 of the Constitution by Saeed’s wife, Shazia Javed. She contends that her husband was forcibly taken from their residence in Islamabad’s E-9 Sector on January 1, 2024, by unidentified government personnel, and has since remained in illegal custody without formal charges or access to due legal process.
The petition accuses the Pakistan Air Force (PAF) and federal authorities of violating fundamental constitutional rights, as well as international human rights treaties to which Pakistan is a signatory. It also highlights the suspension of Saeed’s pension and his wife’s medical entitlements without a lawful justification.
The petitioner urged the court to direct the authorities to either formally charge Saeed in a court of law or release him immediately.
