An attempt to get release of Imran Khan on parole appears a Bobby trap leading to quit him from politics. Hashmat Habib President Tehreek e Tahafuzz e Adlia surprised to hear about moving an application before Islamabad High Court by CM KPK to release his leader on perole.
This petition is in continuous of a written request to CM Punjab Marium Nawaz. Hashmat Habib said release on parole is permissible under Good Conduct Prisoners probational release Rules 1927 and it is function of executive nature, however, court may also invoke its inherent powers and pass executive orders on parole 1934.
Hashmat Habib said it is claim of PTI that their leader is prepared to face all circumstances however release on parole under order 6 of rule 9 in favor of adolescent should be sparingly exercise and generally in respect of those for whom vacancies exist at the bostal form and under order 7 those prisoners are entitled for release can be taken up by the Assistant Director for consideration on applications by prisoners or his relatives and friends and also on the recommendation of superintendent.
Hashmat Habib said the object of parole release is to remove the eligible prisoner from the society of prisoners with definite criminal tendencies, other same criminal characteristics and who from their anticident and conduct in jail appear likely abstain from crime and lead to an industrious life.
Hashmat Habib said the convict in question is eligible for conditional release under the rule and if he is released on parole his conduct will live and work in the restricted area etc. Hashmat Habib said prisoner for release on parole submits a bond along with bond of surities and he remains under the supervision of concerned Assistant director. Hashmat Habib said neither any court can take this responsibility nor any authority that Imran Khan will act accordingly.
He said in fact if Imran Khan is released on parole and remain by the conditions then his politics will come to an end therefore we are of the opinion that the convict prisoner will not agree with the contention of his party workers and may apply his mind.
