We are shocked to listen to a report on Norani’s brother’s disappearance which appears an ill-advised attempt to shake the confidence of people in the judiciary. Hashmat Habib President Tehreek e Tahafuzz e Adlia with a heavy heart said conspiracy to create hatred against any judge in particular and the Judicial system in general is highly condemnable, therefore, it should be stopped forthwith and proper legal action should be taken against the culprits.
Hashmat Habib said last Friday after the Jumma Prayer in a court of Justice Inaam Ameen Minhas was assembled and notices were issued on the petition under 491 Cr.PC for Monday is the first opening day of the Court proceeding.
He said that 491 under chapter XXXVII empowered the High court, session Judge, or additional Session Judge to issue direction of the nature of a habeas Corpus provided the Court thinks it fit that any person within the limits of its appellate Criminal Jurisdiction be brought up before the Court to be dealt with according to law.
It is common sense that such direction should be given forthwith provided the place of illegal or improper detention of the person is known otherwise court can call for the report from the State to ascertain the facts. Hashmat Habib said this is a clear legal position which is known to even a beginner but it is unfortunate that the media is being abused by making improper and uncalled-for commentary showing their intention and purpose.
Hashmat Habib said in the case of a blind FIR or complaint no action can be taken without surfacing the detention place and illegal acts, therefore, the social media person should be careful making any adverse baseless remarks.
Hashmat Habib said we have guidance from the last address of our beloved Prophet (P. B. U. H) that action can be taken only against the accused not against his relations. He said we all are bound to respect the constitution and law otherwise we cannot prosper. We must keep in mind that no one is above the law.
